Repealing The 2nd Amendment Is Not As Easy As Trump Supporters Think
Donald Trump supporters seem to think that Hillary Clinton would have the power to repeal the 2nd amendment if elected president. If any of them actually read the US Constitution, or the Bill of Rights, which contains the 2nd amendment, they would know they are being lied to.
In order to repeal the 2nd amendment, or any other amendment, Article V of the US Constitution states:
The Congress, whenever two thirds of both houses shall deem it necessary, shall propose amendments to this Constitution, or, on the application of the legislatures of two thirds of the several states, shall call a convention for proposing amendments, which, in either case, shall be valid to all intents and purposes, as part of this Constitution, when ratified by the legislatures of three fourths of the several states, or by conventions in three fourths thereof, as the one or the other mode of ratification may be proposed by the Congress; provided that no amendment which may be made prior to the year (1808) one thousand eight hundred and eight shall in any manner affect the first and fourth clauses in the ninth section of the first article; and that no state, without its consent, shall be deprived of its equal suffrage in the Senate.
Therefore, gun lovers should be happy to know that the president has never had the power to repeal constitutional amendments. That power lies with both houses of Congress.
Not only would such an amendment have to be passed by a super-majority in the House and Senate, it would still not become the law of the land until the measure was also ratified by two-thirds of the states.
Since its inception, there have been 27 amendments to the US Constitution. It is a long and complicated process that would require an enormous amount of bipartisan cooperation. If anyone believes that’s going to happen in the current political climate, they’re dreaming.
Donald Trump, and other pro-NRA lawmakers, either don’t have a basic understanding of how the US Constitution works, or they do, and are lying to people about how easy it is to change it.
