Fox’s Judge Nap on Trump’s Threats: The First Amendment ‘Does Not Regulate Twitter’

Fox News’ senior judicial analyst Judge Andrew Napolitano poured cold water on President Donald Trump’s threat to regulate or shut down social media sites on Wednesday. Napolitano explained that the President’s complaints about the First Amendment wouldn’t help him in this situation.

“So the First Amendment, which guarantees the freedom of speech and of the press, since it only regulates the government, does not regulate Twitter,” Napolitano told America’s Newsroom.

“Twitter can take down, modify or correct any user it wants including the President of the United States,” he said.

“As for his threat to regulate or put Twitter out of business, that of course would require legislation which is somewhat unlikely between now and November”

“There also would be legal issues if the effort were aimed at silencing someone who has the freedom of speech.”

Earlier in the day, Trump took to Twitter to threaten it with regulation or closure if conservatives were silenced. This was a response to the site’s decision to provide fact checks under some of his recent tweets which contained false claims about mail-in ballots.
