Fox’s Ainsley Earhardt Incredulous As Judge Nap Tells Her A Rape List Shouldn’t Prevent You Getting A Gun

Judge Andrew Napolitano appeared on Fox & Friends Tuesday morning to discuss the recent mass shootings in Ohio and Texas. Napolitano was keen to emphasize the constitutional right to bear arms and he criticized any measures that would take guns away from law-abiding citizens.

Napolitano was discussing President Donald Trump’s suggestion for ‘red flag’ laws that could identify potentially dangerous individuals. The judge didn’t buy it.

“I don’t know what executive action he would take. And again, is he in a real bind because is he pro-Second Amendment but he sees the people weeping,” Napolitano said.

“Judge, this is just common sense,” co-host Ainsley Earhardt said. “We all knew someone in high school and you thought, gosh, they have potential to be someone great but they’re probably gonna blow it. There are these people — this guy, that’s a red flag.”

By ‘this guy’, Earhardt meant the suspect in the Dayton, Ohio shooting.

“Red flags are apparent only with hindsight. No-one would have said this about this guy,” Napolitano said.

“Really? If my kid had a rape list?” An incredulous Earhardt said.

“If my kid had a rape list, I would, A, get that kid a lot of help, a lot of prayer. And I would not want a gun in that child’s hand. That’s just common sense.”

“This is an adult. This is not a child. This is a child when he wrote the list,” Napolitano told her. “Listen, I’m certainly not defending his behavior. His behavior is reprehensible. But, honest, decent, law-abiding people should not lose their rights because some judge thinks they might do something in the future. That’s the Soviet Union model, not the American.”

Earhardt, the only woman on the panel and a mother, was obviously unhappy with Napolitano’s conclusion and persisted.

“Judge, this kid, if he wrote a rape list when he was 18, I’m sure there’s a lot of things he did at 19, 20 and 21 that were red flags, too, though.”
